Under the Affordable Care Act, employer payment plans and certain other employer health care arrangements are considered group health plans that do not comply with many of the ACA’s key market reforms. This includes the annual dollar limit prohibition and preventive services requirements.
For employers that are still paying for their employees’ individual health plan premiums, they are at risk for a $100 per day penalty, per employee.
